Not even a week has passed since India’s Supreme Court passed the historic decision of decriminalizing homosexuality and complications have already started popping up. Section 377 and its scrapping hasn’t gone down well with the heads of a certain ‘special’ religion who claim that permitting gay sex shall result in widespread moral degeneracy.
“Our religion is very accommodating for all types of degenerate behaviour – whether it is incest or bestiality or Nikah Halala – isn’t that enough? Why do you need this?” questioned a Maulvi from West Bengal.
Many controversies cropped up following the Supreme Court’s judgement and in one such complicated case, a Muslim gay couple who got into trouble after giving Triple Talaq to each other, now want to get re-married. As per Islamic traditions, a female has to go through the process of Nikah Halala under which she is expected to marry and consummate marriage with someone else, preferably the local Maulvi, before remarrying the same person who had given her the Triple Talaq in the first place.
The local Maulvi who has been offered to do Nikah Halala is totally baffled since he has previously indulged in doing so for several women but cannot reject the current offer without any proper justification. Another confusion is about whether or not both of the men would have to get ‘purified’ by the Maulvi in order to become lawful again. Currently, the couple is considering a legal case against the Maulvi, however, no clarity has been put up by the laws related to 377 yet.
